The purpose of this work is to highlight the influence of political gender violence on women's participation in public life, in order to analyze the legal and social aspects of the edition of Law n. 14.192/21, which criminalized this type of violence, in order to verify whether the standard is adequate and sufficient to increase female participation and enable reflections on the existence of other mechanisms for tackling the problem. Therefore, the social roles historically delegated to women in patriarchal society will be investigated, as well as the main obstacles encountered by women in entering and holding elected positions, highlighting the impact of gender-based political violence, especially in its symbolic form. Furthermore, through the analysis of the experience of the Maria da Penha Law, reflect on the effectiveness of using criminalization as the only mechanism to combat gender-based violence, considering the cultural roots of the conduct. The hypothetical-deductive method was used, focusing on exploratory, qualitative and descriptive research, through the analysis of legislation, works and scientific articles aimed at understanding the topic, in order to demonstrate the need to evolve legally and socially in the fight against to gender-based political violence to achieve democracy.
