This research seeks to analyze the process of implementing the effectiveness of the constitutional guarantee of the human and fundamental right to early childhood education. To this end, the consequences of Constitutional amendment no. 59/09, using a qualitative, descriptive approach with documentary analysis of laws related to early childhood education, mainly the National and Municipal Education Plans, their processes and developments. Two municipalities were chosen as the research locus: Araçatuba-SP and Três Lagoas-MS. The research is theoretically based on authors such as: Augusto (2002), Bobbio (1992), Comparato (2010), Cury (1998, 2002), Dourado (2007,2010), Duarte (2004), Fachin (2001), Kramer (2011), Oliveira (2007), Netto (2011), Rizzo (2003), Rosemberg (2015), Sarmento (2012), Severino (2013) and Triviños (1987). It is worth considering that education is a right for everyone, evidenced in the Universal Declaration of Human Rights, as well as in international documents, the constitutional text and Brazilian infra-constitutional legislation. However, not all municipalities complied with the regulations regarding the adjustment of Law No. 9,394, of December 20, 1996 (Law of Guidelines and Bases for National Education) and Constitutional Amendment no. 59, of November 11, 2009, which makes the provision of free basic education mandatory from the age of 4 onwards
