DEMOCRATIC MANAGEMENT OF/IN MUNICIPAL EDUCATION IN TIMES OF PANDEMIC AND POST-PANDEMIC IN THE CENTRAL-WEST REGION TITLE IN ENGLISH: unveiling contexts and challenges (old/new) of educational law

Resumo: | The democratization of basic education is the right of all citizens, not restricted to the objective of the government or the State. In this article, the objective is to apprehend the changes that took place in mucicipal education policy and management in the years 2020 to 2021 (pandemic period of Covid 19) in the Central-West Region that covers the States of Goiás, Mato Grosso, Mato Grosso do Sul and the Federal District, totaling a group of 466 municipalities. With analysis and interpretation from a critical perspective, it is based on documentary research, based on official documents from the Ministry of Education and complementary norms from the States and Municipalities themselves, with a focus on guaranteeing the right to education. Through a historical approach, in which milestones of educational policy and management stand out, the text seeks to present elements that ensure the right to education as guaranteed by the Federal Constitution of 1988; the Law of Guidelines and Bases of National Education – Law nº 9.394/1996; and the National Education Plan 2014/2024 - Law No. 13,005/2014, in its guidelines and goals and strategies, especially considering the principle of democratic management of public education, as its maintenance is understood as a collective, participatory process, with autonomy and political emancipation, from the macro dimension (education systems) to the micro dimension (even school units). The results denote changes/adjustments in the school calendars in the municipalities; social inequalities (internet access/absence); and greater participation of families and appreciation of teachers. |

En este artículo, el objetivo es aprehender los cambios ocurridos en la política y gestión de la educación municipal en los años 2020 a 2021 (período de pandemia de Covid 19) en la Región Centro-Oeste que comprende los Estados de Goiás, Mato Grosso, Mato Grosso do Sul y el Distrito Federal, totalizando un grupo de 466 municipios. Con análisis e interpretación desde una perspectiva crítica, se basa en una investigación documental, basada en documentos oficiales del Ministerio de Educación y normas complementarias de los propios Estados y Municipios, con un enfoque en la garantía del derecho a la educación. Mediante un abordaje histórico, en el que se destacan hitos de la política y gestión educativa, el texto busca presentar elementos que aseguran el derecho a la educación garantizado por la Constitución Federal de 1988; la Ley de Directrices y Bases de la Educación Nacional – Ley nº 9.394/1996; y el Plan Nacional de Educación 2014/2024 - Ley N° 13.005/2014, en sus lineamientos y objetivos y estrategias, considerando especialmente el principio de la gestión democrática de la educación pública, en tanto su mantenimiento es entendido como un proceso colectivo, participativo, con autonomía y emancipación política, desde la dimensión macro (sistemas educativos) a la dimensión micro (incluso unidades escolares). Los resultados denotan cambios/ajustes en los calendarios escolares de los municipios; desigualdades sociales (acceso/ausencia de internet); y mayor participación de las familias y valoración de los docentes.A democratização da educação básica é direito de todos os cidadãos, não se restringindo ao objetivo do governo ou do Estado. Neste artigo, objetiva-se apreender as mudanças que se processaram na política e gestão da educação municipal nos anos de 2020 a 2021 (período pandêmico da Covid 19) na Região Centro-Oeste que abrange os Estados de Goiás, Mato Grosso, Mato Grosso do Sul e o Distrito Federal, totalizando um conjunto de 466 municípios. Com análise e interpretação na perspectiva crítica, pauta-se na pesquisa documental, a partir de documentos oficiais do Ministério da Educação e normas complementares dos próprios Estados e Municípios, com foco na garantia do direito à educação. Por meio de uma abordagem histórica, em que se destacam marcos da política e gestão educacional, procura-se apresentar no texto elementos que asseguram o direito à educação conforme garante a Constituição Federal de 1988; a Lei de Diretrizes e Bases da Educação Nacional – Lei nº 9.394/1996; e o Plano Nacional de Educação 2014/2024 – Lei nº 13.005/2014, em suas diretrizes e nas metas e estratégias, sobretudo considerando o princípio da gestão democrática do ensino público, pois sua legitimidade é entendida como um processo coletivo, participativo, com autonomia e emancipação política, desde a dimensão macro (sistemas de ensino) até a micro (unidades escolares).
