Resumo: | The principle of publicity in criminal proceedings is now recognized as a fundamental human right due to its close relationship with the principle of fair trial, democracy, and the rule of law. Going beyond a mere formality, this principle is essential for achieving substantive justice. However, publicity may be waived in exceptional cases to the extent strictly necessary. Therefore, uncontrolled and implementation of these limitations with no transparency by the courts can lead to situations of secret justice capable of undermining this social achievement. Focused on reflecting on the hypotheses of legitimate restriction to the scope of protection of this principle and the consequences arising from its breach, this doctoral thesis focuses on the principle of publicity in proceedings dealing with human trafficking, since such proceedings typically involve scenarios with the potential to justify the taking of this exceptional measure. The question is: is the (non) imposition of secrecy in these proceedings in line with current constitutional and international guidelines? Articles 5, LX and 93, IX, of the Brazilian Constitution of 1988 provide for the possibility of restricting publicity in the face of the right to privacy. In the case of a conflict between fundamental rights and the absence of a constitutional, infra-constitutional, or treaty rule that expressly determines the suppression of procedural publicity in favor of privacy in the case of investigation of human trafficking, the decision to impose secrecy in the proceedings relating to the crime must have constitutional motivation and observe the proportionality rule, according to Robert Alexy's understanding and the respective adaptations of Virgílio Afonso da Silva to the internal legal order, similar to other cases involving a conflict of fundamental rights and that are the subject of decisions emanating from the higher courts of the Brazilian justice system. In this regard, ten judicial proceedings dealing with the practice of the crime typified in Article 149-A of the Brazilian Penal Code, which were mainly processed in the Regional Federal Courts of Brazil, were analyzed to verify the legal and factual precepts used to decide on the application of the general rule of procedural publicity or the exception of secrecy in the cases analyzed, through the data collected on their official websites, as well as on the Jusbrasil.com jurisprudential search site. The study was based on semantic, historical, legal, and jurisprudential analyses, provided by a bibliographic survey of the academic production that surrounds the theme; secondary data about the object of study; and documentary review of judicial proceedings dealing with human trafficking, enabling a theoretical-practical activity, which characterizes the research as exploratory and descriptive. Based on doctrinal and documentary analysis, it was demonstrated that there is no reasonable and coherent systematization, imbued with constitutional motivation, in the imposition of secrecy in a significant number of judicial proceedings dealing with the crime of human trafficking, a fact that culminates in the non-effectuation of the fundamental principle of Procedural Publicity, revealing, therefore, strong indications of unconstitutionality of the decisions rendered. |

El principio de la publicidad en los procesos penales es hoy reconocido como un derecho humano y fundamental por ser una conquista social íntimamente relacionada con el principio de la justicia procesal, con la democracia y con el estado de derecho. Más allá de la condición de mera formalidad, dicho principio es indispensable para alcanzar la justicia sustantiva. No obstante, la publicidad podrá ser suprimida excepcionalmente en la medida estrictamente necesaria. Por lo tanto, la implementación descontrolada y no transparente de estas limitaciones por parte de los tribunales puede generar situaciones de justicia secreta capaces de socavar dicha conquista social. Centrada en reflexionar sobre hipótesis de legítima restricción al alcance de la protección de este principio y las consecuencias que se derivan de su incumplimiento, esta tesis doctoral se centra en el principio de publicidad en los procesos que tratan de trata de personas, ya que tales procesos suelen involucrar escenarios con el potencial para justificar la adopción de esta medida excepcional. La pregunta es: ¿la (no) promulgación del secreto de justicia en estos procesos está en consonancia con los lineamientos constitucionales e internacionales vigentes? Los artículos 5, inciso LX y 93, inciso IX, de la Constitución de 1988 prevén la posibilidad de restringir la publicidad en atención al derecho a la intimidad. Siendo que se trata de un conflicto entre derechos fundamentales y no existe norma constitucional, infraconstitucional o convencional de la que Brasil sea parte, que determine en definitivo la supresión de la publicidad procesal en favor de la intimidad en el caso de investigación de trata de personas, la decisión que decreta el secreto de justicia en los procesos relacionados al delito debe tener motivación constitucional, así como observar la regla de la proporcionalidad, según los entendimientos de Robert Alexy y las respectivas adaptaciones de Virgílio Afonso da Silva al ordenamiento jurídico interno, igualmente a los demás casos que impliquen conflicto entre derechos fundamentales y san objeto de decisiones emitidas por los tribunales superiores del sistema de justicia brasileño. Así, se analizaron diez procesos que versaran o aún versan sobre la práctica del delito tipificado en el artículo 149-A, del Código Penal brasileño, que tuve o tienen su trámite, en mayoría, en los Tribunales Regionales Federales de Brasil, para, a través de los datos recogidos en sus sitios oficiales, así como en el sitio de búsqueda de jurisprudencia Jusbrasil.com, verificar los preceptos factuales y de derecho utilizados para decidir sobre la aplicación de la regla general de publicidad procesal o sobre la excepcionalidad del secreto en los casos analizados. El estudio se basó en análisis semántico, histórico, jurídico y jurisprudencial, proporcionado por un levantamiento bibliográfico entre la producción académica que rodea el tema; datos secundarios sobre el objeto de estudio; y revisión documental de procesos judiciales relacionados con la trata de personas, posibilitando una actividad teórico-práctica, que caracteriza la investigación como exploratoria y descriptiva. Del análisis doctrinario y documental, queda demostrado que no existe una sistematización razonable y coherente, revestida de motivación constitucional en la vigencia del secreto de justicia en un número relevante de procesos judiciales que versan sobre el delito de trata de personas, un hecho que culmina en la ineficacia del principio fundamental de Publicidad Procesal, revelando fuertes indicios de inconstitucionalidad de las decisiones dictadas.NenhumaO princípio da publicidade no processo penal é hoje reconhecido como um direito humano e fundamental por se tratar de uma conquista social intimamente relacionada ao princípio do fair trial e, assim, à democracia e ao estado de direito. Ultrapassando a condição de mera formalidade, referido princípio é indispensável para o alcance da justiça material. Não obstante, a publicidade pode ser afastada em hipóteses excepcionais na medida estritamente necessária. Portanto, a operacionalização descontrolada e sem transparência dessas limitações pelos tribunais pode gerar situações de justiça secreta capazes de minar a referida conquista social. Concentrada em refletir sobre as hipóteses de restrição legítima ao âmbito de proteção desse princípio e as consequências decorrentes do seu descumprimento, esta tese de doutorado se debruça sobre o princípio da publicidade nos processos que tratam do tráfico de pessoas, uma vez que tais processos tipicamente envolvem cenários com potencial de justificar a tomada dessa medida excepcional. Pergunta-se: a (não) decretação do segredo de justiça nesses processos está em consonância com as diretrizes constitucionais e internacionais vigentes? Os artigos 5º, inciso LX, e 93, inciso IX, da Constituição da República de 1988 preveem a possibilidade de restrição à publicidade frente ao direito à intimidade. Tratando-se de conflito entre direitos fundamentais e inexistindo regra constitucional, infraconstitucional ou de tratados de que o Brasil é parte, que taxativamente determine a supressão da publicidade processual em favor da intimidade no caso de apuração do tráfico de pessoas, a decisão que decreta o segredo de justiça nos processos inerentes ao crime deve ter motivação constitucional, bem como observar a regra da proporcionalidade, conforme entendimentos de Robert Alexy e respectivas adaptações de Virgílio Afonso da Silva, e a ordem jurídica interna, à semelhança dos demais casos que envolvem conflito entre direitos fundamentais e são objeto de decisões emanadas pelas Cortes superiores do sistema de justiça brasileiro. Nesse viés, foram analisados dez processos judiciais que tratam da prática do crime tipificado no Artigo 149-A, do Código Penal brasileiro, que tramita(ra)m majoritariamente nos Tribunais Regionais Federais do Brasil, para, mediante os dados colhidos em seus sites oficiais, bem como no site de busca jurisprudencial Jusbrasil.com, verificar os preceitos jurídicos e factuais utilizados para decidir pela aplicação da regra geral da publicidade processual ou pela excepcionalidade do segredo nos casos analisados. O estudo foi alicerçado em análises semântica, histórica, legal e jurisprudencial, proporcionadas por um levantamento bibliográfico dentre a produção acadêmica que circunda a temática; dados secundários acerca do objeto de estudo; e revisão documental de processos judiciais que tratam do tráfico de pessoas, viabilizando uma atividade teórico-prática, que caracteriza a pesquisa como exploratória e descritiva.
