Resumo: | Mercantile culture in medievaltimes was a complex phenomenon notrestricted to modern limitations due to theprocess of codification. Mercantile practicesdid not limit themselves to legislated tradelaw on the basis of abstract rules but theymanifest themselves through the habits ofcorporation’s members and professionals.Such habits were rights derived from theirpractices and more than autonomous legalrules they were primary sources for lawmaking. These common law rules werethe law of merchants and they determinedstandards for professional behavior andcommodities trade. Commercial or tradepractices expressed the tradition of iuscommune with a strong religious andcooperative feature based on the valueof friendship. |

As práticasmercantis não se limitavam ao direitocomercial legislado com normas abstratas,mas se expressavam nos costumes deprofissionais e de membros de corporaçõesem suas atividades diárias. Esses costumeseram direitos originados da prática e, mais doque normas jurídicas autônomas, eram fontesprimárias para a produção do direito.
