The principle of patient autonomy and its relations with the law

Resumo: Perhaps no other professional activity has prompted as much discussion and reflection about ethical behavior as the activity of health care workers. Ethical dilemmas arepresent in health care every time a discussion, procedure, or action affect people. The decision-making situations generated by these dynamics always involve the principle of individual autonomy. The principle of autonomy appears currently as the most complicated issue in discussions involving doctors, jurists, and ethicists. The consequence of this is made evident by the increasing number of legal actions involving physicians and health care institutions. The objective of the present paper is to discuss the concept of autonomy and the importance of defining a juridical approach regardingthis topic.

Sempreque discussões, procedimentos ou ações nesta área afetarem pessoas, dilemas éticos estarão estabelecidos. Isto gera uma tomada de decisões que sempre envolve aautonomia dos indivíduos. E é este princípio da autonomia que aparece, atualmente, como ponto de discussão acirrada entre médicos, juristas e eticistas. O reflexo deste processo vem se manifestando pelo aumento progressivo no número de ações judiciaisenvolvendo médicos e instituições de saúde.
