Resumo: Cell therapies involving stem cells are one of the major scientific advances in the 20th century and are considered as one of the hopes for the future of medicine. From the stem cells perspective, medical, economical and ethical issues are all intertwined. Using the complex bioethics model, this article demonstrates that patents are not the appropriate legal instrument to ensure the promotion of research with stem cells in order to safeguard public health or even for sharing the knowledge generated by studies on this field. Informed consent from research subjects or donor’s biological samples must be required in all studies involving human samples that generate patents, as a way to respect human rights

Do ponto de vista das células-tronco, as questões médicas, econômicas e éticas estão todas entrelaçadas. Utilizando o modelo de bioética complexa, demonstramos que as patentes não são o instrumento jurídico adequado para garantir a promoção da pesquisa com células-tronco, visando salvaguardar a saúde pública ou até mesmo o compartilhamento dos conhecimentos gerados pelas pesquisas neste campo.
