State of the art of the public-private relation in k-12 education

One of the oldest debates in public educational policies is, undoubtedly, the participation of the private sector in educational services and the destination (or prohibition of use) of public funds for private schools. Taking advantage of the gaps opened with the drafting of the Federal Constitution of 1988, the private sector deepened its presence in the service provision in K-12 education. Census data show a strong presence of the sector and a number of institutions that survive receiving public resources for the maintenance of placements offered by them. Contrary to what was expected, it is in the capitals that we find situations that most counter the achievement of education as a universal right and a duty of the State. Despite safeguards present in the National Education Plan, federal programs and legal changes are strong signs that larger portions of the educational provision may be occupied by the private sector in the next decade
