Resumo: Over the years, for various reasons, the Brazilian Supreme Court (STF) has been receiving increasing attention from the media, the academia, and the society in generalWithin this context, different aspects of the Court's performance have been observed and criticized, including its deliberative process. This monograph focuses on a problem within this field, related to the structure and composition of the Court's judgments. Considering that the STF's internal regulations provide for an essentially aggregative model of voting, without a joint written or institutional text element, this study seeks to determine how this impacts the coherence of the different reasons present in decisions rendered in judicial review. In addition, it aims to verify if and how this possible inconsistency affects the obligation of reasoning for judicial decisions provided by the Constitution. To achieve this, a documentary and bibliographic research is carried out, which is essentially deductive, accompanied by concrete cases examples.

Com esse enfoque, muitos diferentes aspectos da atuação do tribunal têm sido alvo de observação e de crítica, dentre os quais se destacam os apontamentos acerca da forma de deliberação presente no STF. Nesse cenário, a presente monografia tem por objeto um problema que se insere nesse campo, referente à estrutura e à composição dos acórdãos do tribunal. Considerando que o regimento interno do STF prevê um modelo essencialmente agregativo de votos, sem a presença de um elemento textual escrito em conjunto pelos ministros ou de forma institucional, busca-se aferir como isso impacta na congruência dos diferentes fundamentos presentes nas decisões proferidas em controle concentrado de constitucionalidade. Além disso, cumpre verificar se e como essa eventual incongruência atinge a obrigatoriedade de fundamentação das decisões judiciais prevista pela Constituição de 1988.
