Resumo: Abstract The work is based on the intertwining of the bases themes, namely, the alternative dispute resolution applied in shared custody in the Brazilian social and legal context, having as factual situation the film "Marriage Story". The research covers with a brief historical disposition of the alternative dispute of conflict resolution in Brazilian law, the models of custody with a focus on shared custody and application, both in cases of consensual and litigious separation. Thus, for the accomplishment of the present work, the bibliographic method was widely used, to detail the benefits applicable to shared custody, not only highlighting the legal panoramas, but also issues related to the emotional structure of the parties. The article shows that mediation remains as a full alternative for the resolution of family conflicts, as it helps the subjects involved to maintain a better relationship between them.

The article shows that mediation remains as a full alternative for the resolution of family conflicts, as it helps the subjects involved to maintain a better relationship between them.O trabalho pauta-se no entrelaçamento dos temas bases, quais sejam, os meios alternativos de resolução de conflitos aplicados na guarda compartilhada no contexto social e jurídico brasileiro, tendo por situação fática o filme “História de um Casamento”. A pesquisa percorre com breve disposição histórica dos meios alternativos de resolução de conflitos no direito brasileiro, os modelos de guarda com um enfoque principal à guarda compartilhada e à aplicação, tanto nos casos de separação consensual como litigiosa. Assim, para a realização do presente trabalho foi utilizado dilatadamente o método bibliográfico, para pormenorizar os benefícios aplicáveis a guarda compartilhada, não apenas evidenciando os panoramas jurídicos, mas também questões relacionadas à estrutura emocional das partes.
