This study will analyze how the accidents involving autonomous vehicle will be resolved, in other words, how will be the legal solution on the resolution of the question. Such accidents already occurred and among others, with fatal victim. Through the analysis of the current legal framework and the work of experts in Brazil and on foreign legal systems, the purpose of this paper is to achieve a solution on the subject of the accidents that probably will occur. The results achieved is that in the absence of law regulating the topic, should be used analogy to fulfill the gap of the law. Should be used the consumerist law and the strict liability of the manufacturer, since the vehicle is a product, in a consumerist sense. Thus, the importance of this paper relies on the possible future discussions, since the autonomous vehicles will be more common in everyday life.
