Resumo: In the area of Science, Technology and Society, and Law, the general objective of the text is to foster a new indicator of power, based on technological material developed with the increase of Artificial Intelligence (AI). This paper provides a discussion about Law and technology and the need for emancipatory functions in the management of the Artificial Intelligence (AI), at the risk of becoming an update of totalitarianism. Through a hypothetico-deductive method, conjunctures are discussed and through a bibliographical research, it is possible to conclude that the distancing of humanistic aspects can lead to the management of technology for deleterious purposes.

O texto propicia a discussão sobre Direito e tecnologia enquanto imbricados e a necessidade de funções emancipatórias no manejo da Inteligência Artificial (IA), sob pena de tornar-se em atualização do totalitarismo.
