Psychological health: he need for greater protection through personality rights

Resumo: From the amplitude of the relevance of mental health issues in society, this paper seeks to analyze the relationship between personality rights and mental health. From the conception of the individual as the end of the law, the right of personality acquires protagonism for being the grouping of the essential rights of the human being, and thus it deals with issues of physical and mental health. However, in the Brazilian legal system, there is more protection of physical health and less of mental health. Through bibliographical research and analysis of laws and norms, it was concluded that the Brazilian legal system lacks specific protection of personality rights related to mental health, and that it is necessary to adopt specific norms that guarantee the protection of individuals with regard to mental health.

A partir da concepção do indivíduo como fim do direito, o direito da personalidade adquire protagonismo por ser o agrupamento dos direitos essenciais ao ser humano e, assim, versa sobre questões de saúde física e psicológica. Entretanto, no ordenamento jurídico brasileiro, há maior tutela da saúde física e menor da saúde psicológica.
