Resumo: On the bias towards the principles of Environmental Law, this research aims specifically to verify the state of conservation of cemeteries in the Municipality of Macaé, which can lead to the contamination by necropolis, affecting the health of residents, as well as to determine the possible reasons that inhibited the municipal adaptation to the regulations of the National Council for the Environment (Conama). There were adopted, as methodology, the bibliographical research and a field research carried out engaging the municipal agencies who inspect and maintain these cemeteries. As a result of the research, non-compliance with Conama regulations was detected in the municipality, demanding greater care and corrections by who governs this area.

As a result of the research, non-compliance with Conama regulations was detected in the municipality, demanding greater care and corrections by who governs this area.Mediante o viés que encontra abrigo nos princípios do Direito Ambiental, esta pesquisa objetiva especificamente verificar o estado de conservação dos cemitérios instalados no Município de Macaé, o que pode levar a contaminação aos residentes nas áreas limítrofes as necrópoles pelo necrochorume, afetando a saúde dos moradores, bem como determinar os possíveis motivos que inibiram a adequação municipal aos normativos do Conselho Nacional do Meio Ambiente (Conama). A metodologia utilizada foi a pesquisa bibliográfica, bem como a pesquisa de campo, junto aos órgãos municipais que atuam na fiscalização e manutenção desses cemitérios.
