Resumo: Colombia is a country with Roman-Germanic legal current, in wich, copyright is divided into patrimonial and moral rights. In the case of moral rights, when infringements are committed on them, there are some difficulties in assessing non-pecuniary damages, since their nature of non-negotiable and inalienable does not allow it to be easy to determine their quantification. This article presents what are the main issues that exist in the Colombian legal system for the valuation of non-pecuniary damages for infringements of moral rights of copyright and how this valuation should be in order to be adequate, taking by example the case of España.

En el caso de los derechos morales, cuando se cometen infracciones que recaen sobre estos, existen algunas dificultades para tasar los perjuicios extrapatrimoniales, pues su naturaleza de innegociables e inalienables dificulta determinar su cuantificación.
