Resumo: Historically a subject belonging to the gray area of ??law, the prescription in the inheritance petition deserved, in recent times, the formation of a dominant jurisprudence by the Superior Court of Justice. The evolution of the treatment of matter can, perfectly, be analyzed in time with the well-known opera The Four Seasons, by Antonio Lucio Vivialdi, due to the variation of criteria and solutions. In a grand finale, we must be aware of the need to use the distinguishing method in relation to the currently prevalent understanding.
