Fake News: A pragmatic analysis of the effects of the phenomenon on Journalism and Law

Resumo: The article proposes a reflection on how the phenomenon of “fake news”, as a political strategy, has awakened transformations in Jornalismo e no Direito. Based on pragmatism, we analyze specific cases that contextualize and present consequences of the phenomenon in order to seek the possibilities for an effective freedom of expression in digital communication. For this, we adopt Park's (1940) notion of news as a form of knowledge and democratization of public interest in Dewey (1927).

Con base en el pragmatismo, analizamos casos concretos que contextualizan y presentan consecuencias del fenómeno para buscar las posibilidades de una efectiva libertad de expresión en la comunicación digital. Para ello, adoptamos la noción de noticia como forma de conocimiento y democratización del interés público de Park (1940) en Dewey (1927).O artigo propõe uma reflexão sobre como o fenômeno das “fake news”, enquanto estratégia política, despertou transformações no Jornalismo e no Direito. Sob o viés do pragmatismo, analisamos casos concretos que contextualizam e apresentam consequências do fenômeno a fim de buscar as possibilidades para uma efetiva liberdade de expressão na comunicação digital.
