Resumo: | The Federal Constitution of 1988 recognized the family as the basis of society, guaranteeing it special protection and ensuring the fundamental right to family life for children, which translates into the guarantee of being raised and educated within the family itself and, exceptionally, when this is not possible, in a foster family. Despite that, even though the Statute of the Child and Adolescent has ratified the right to family life, it has also indicated the possibility of applying a protective measure, the shelter in entities, which remove children from families, even if it is circumscribed under the prism of exceptionality and brevity. Faced with this paradox, it is essential to know this measure deeply, circumscribing it under the prism of the integral protection’s doctrine. |

La Constitución Federal reconoce a la familia como base de la sociedad, por lo que garantiza una protección especial por parte del Estado y garantiza a los niños y adolescentes el derecho fundamental a la vida familiar, aunque sea en una familia sustituta. El Estatuto del Niño y del Adolescente, a pesar de ratificar el derecho a la vida familiar, también señala la posibilidad de aplicar una medida de protección que los aleje de la convivencia con cualquier familia, en este caso, la medida de abrigo en entidad, aunque observe los principios de excepcionalidad y brevedad. Ante esta paradoja, se hace imprescindible conocer en profundidad tal medida, circunscribiéndola bajo el prisma de la Doctrina de la Protección Integral. A Constituição Federal reconhece a família como a base da sociedade, garantindo-lhe especial proteção do Estado e assegura à criança e ao adolescente o direito fundamental à convivência familiar, ainda que em família substituta. Apesar disso o Estatuto da Criança e do Adolescente, muito embora tenha ratificado o direito à convivência familiar, também indicou a possibilidade de aplicação de uma medida de proteção que afasta a criança e o adolescente do convívio com qualquer família, no caso, a medida de acolhimento institucional, ainda que a tenha circunscrito sob o prisma da excepcionalidade e da brevidade. Diante deste paradoxo, é imprescindível conhecer, com profundidade, tal medida, circunscrevendo-a sob o prisma da Doutrina da Proteção Integral.
