Resumo: Abstract The main aim of this paper is to analyze the importance of the role played by the judiciary in resolving international cases in which it is necessary to apply a gender perspective and how, through their rueles, they collaborate in the fulfillment of the goals of SDG 5. In doing so, the paper will proceed to preliminarily consider the importance of the gender perspective as an analytical category, and then focus on the importance of its use by those who carry out the administration of justice. For an analysis of the specific case, the starting point is Argentine case law on the international child abduction, which has been resolved in different ways, identifing wheter the courts’ approach is base don a gender perspective.

Para ello, se procederá a considerar preliminarmente la importancia de la perspectiva de género como categoría analítica, para posteriormente centrarse en la trascendencia de su utilización por quienes llevan adelante la administración de justicia. Para un análisis en el caso en concreto, se parte de jurisprudencia argentina en materia de restitución internacional de niños, niñas y adolescentes, en la que se ha ido resolviendo de distintas maneras, lo que permite identificar si los tribunales abordan los casos con una perspectiva de género.Este trabajo tiene como objetivo analizar la importancia del rol que desempeñan los tribunales al momento de resolver casos iusprivatistas internacionales en los que resulta necesario aplicar perspectiva de género y cómo, a través de su labor, colaboran en el cumplimiento de las metas del ODS 5. Para ello, se procederá a considerar preliminarmente la importancia de la perspectiva de género como categoría analítica, para posteriormente centrarse en la trascendencia de su utilización por quienes llevan adelante la administración de justicia.
