Monografia (Bacharelado em Direito)—Universidade de Brasília, Brasília, 2011.http://bdm.unb.br/handle/10483/2904http://dx.doi.org/10.26512/2011.TCC.2904Monografia (graduação)—Universidade de Brasília, Faculdade de Direito, 2011.Com o presente estudo, busca-se investigar a origem histórica e o desenvolvimento do instituto do reexame necessário no direito processual civil brasileiro, com ênfase em sua natureza jurídica, e, ao final, avaliar a constitucionalidade e a conveniência do instituto no contexto normativo e social atual. O presente trabalho nos remete, em momento inicial, ao sistema inquisitório do processo penal lusitano do período medieval, em que teria surgido sob a denominação de “recurso ex officio”. Sob tal perspectiva, a introdução do instituto no sistema processual civil brasileiro, já em meados do século XIX, é analisada com especial atenção aos interesses sobrelevados com tal instrumento processual. São avaliados, ainda, os aspectos processuais de maior relevo da aplicação do instituto nos tribunais pátrios. Por fim, ante as observações traçadas acerca da constitucionalidade e da conveniência do reexame obrigatório, estuda-se a tendência de desaparecimento do instituto observada em recentes reformas processuais, inclusive no Anteprojeto de Novo Código de Processo Civil em tramitação no Congresso. The present study remind us, at baseline, about the inquisitor system of the Lusitanian penal procedural from the medieval period which would had appeared under the name “ex officio appeal”. Under this perspective, the institute‟s introduction into Brazilian penal procedural system, by mid-nineteenth century, is analyzed with a special attention to the most relevant procedural aspects of the institute‟s application in the patriotic courts. Finally, in view of the drawn observations about the constitutionality and the convenience of the obligatory re-examination, it is studied the institute‟s tendency to disappearance that was observed in recent procedural reforms, including at the New Code‟s Draft of the Civil Procedural which is going through the procedure at the National Congress.
