Resumo: An increase in the number of lawsuits against dental surgeons has been observed in Brazil over the last few years. This study aims to find and analyze case law precedents from the State of Paraná’s Court of Justice (TJPR) regarding dental surgeons’ civil responsibility and to present a profile and understanding of factors involved in such lawsuits. This is a document research carried out through the consultation tool on the TJPR website, under the precedents option, then selecting the precedents research box. After these initial steps, a few keywords were searched: “Dental surgeon”, “Dental clinic”, “Dentist”, “Dental”, “Dentistry error”, “Dentistry”, “Odontology”, “Odontologist”. To filter the lawsuits filed from January of 2010 to December of 2020, the keywords used initially were refined by adding another keyword: civil responsibility of dental professionals. For the analysis of precedents, the lawsuits were reclassified in the following sections: year; the professional’s field of work or expertise; average value of compensation payment. Excel® spreadsheets were designed to register the data from all evaluated lawsuits to avoid double analysis of the same lawsuit when the cross between keywords or any other variable was performed. After gathering research data, graphs and tables were drawn to compare and analyze the final results. Then, we obtained data that show the quantitative and qualitative profile of lawsuits against dentistry professionals and that may guide dental surgeons on the importance of knowing the characteristics of legal demands and their implications in their contemporary professional activities.

Este estudo tem como objetivo conhecer e analisar a jurisprudência do Tribunal de Justiça do Estado do Paraná (TJPR) acerca da responsabilidade civil dos cirurgiões-dentistas, bem como, apresentar o perfil e o entendimento dos fatores envolvidos nestes processos judiciais. Trata-se de uma pesquisa documental, realizada por meio de consulta do site do TJPR, selecionada a opção consulta, a opção jurisprudência, em seguida selecionado o campo pesquisa de jurisprudência. Após a realização destes passos iniciais, serão utilizadas para consulta no campo pesquisa livre as palavras-chave: “Cirurgião-dentista”, “Clínica dentária”, “Dentista”, “Dental”, “Erro Odontológico”, “Odontologia”, “Odontólogo” e “Odontologista”. Para filtrar os processos judiciais que ocorreram no período de janeiro de 2010 a dezembro de 2020, as palavras-chave utilizadas inicialmente foram refinadas com outra palavra-chave, responsabilidade civil do profissional de Odontologia. Para análise da jurisprudência, os processos foram reclassificados da seguinte forma: ano do julgado; área de atuação ou especialidade do profissional; valor médio de indenização. Foram elaboradas planilhas em Excel®, para o registro dos dados dos processos avaliados, para que não fosse contabilizada a análise do mesmo processo quando fosse realizado o cruzamento entre as palavras-chaves ou qualquer outra variável do estudo. Após a coleta dos dados da pesquisa, foram elaborados gráficos e tabelas para comparação e análise dos resultados finais.
