Informed consent in medical interventions involving patients with neurocognitive and psychiatric impairment from the perspective of the un Convention on the rights of persons with disabilities

Resumo: The Law n° 13.146/2015 has given full capacity to people with disabilities, promoting the re-reading of the doctor-patient relationship. Under the ideal of reducing the interference of third parties and medical paternalism in the decision-making of these individuals in health matters, this law restricted the institute of guardianship, in art. 85, caput, to the economic and financial dimensions, excluding from its scope the exercise of existential rights, as is the case of the right to health. In this scenario, the problem of informed consent involving patients with neurocognitive and psychiatric impairment is verified, since the assessment of their will constitutes a complex task. The limited discernment of patients with this profile sometimes supplants the normative aspiration of giving them full autonomy to practice existential acts. A systematic interpretation would allow the harmonization of article 85, caput, of the Statute of the Person with Disability, with the United Nations Convention on the Rights of Persons with Disabilities, recognizing the comprehensiveness of the scope of application of the guardianship regarding the exercise of the right to health, in the cases of the cited patients. Thus, this article seeks to analyze informed consent in medical interventions performed on these individuals, in light of the aforementioned Convention.

La Ley n° 13.146/2015 concedió plena capacidad a las personas con discapacidad, promoviendo verdadera relectura de la relación médico-paciente. Bajo el ideal de disminución de la injerencia de terceros y del paternalismo médico en la toma de decisiones de estos individuos en materia de salud, tal diploma restringió el instituto de la curatela, en el art. 85, caput, a las dimensiones económica y financiera, excluyendo de su alcance el ejercicio de derechos existenciales, como es el caso del derecho a la salud. En este escenario, se verifica la problemática del consentimiento informado involucrando pacientes con comprometimiento neurocognitivo y psiquiátrico, vez que la avaluación de la voluntad de estos constituye tarea complexa. La limitación en el discernimiento de los pacientes con este perfil sobrepasa, por veces, la aspiración normativa de atribuirles plena autonomía para la práctica de actos existenciales. Una interpretación sistemática permitiría armonizar el art. 85, caput, del Estatuto de la Persona con Discapacidad, con la Convención de la Organización de las Naciones Unidas sobre los derechos de las personas con discapacidad, reconociéndose el alcance del campo de aplicación de la curatela en relación al ejercicio del derecho a la salud, en los casos de los pacientes citados. Así, en este artículo se busca analizar el consentimiento informado en las intervenciones médicas realizadas en estos individuos, a la luz de la referida Convención. Sob o ideal de diminuição da ingerência de terceiros e do paternalismo médico na tomada de decisões destes indivíduos em matéria de saúde, tal diploma restringiu o instituto da curatela, no art. 85, caput, às dimensões econômica e financeira, excluindo de sua abrangência o exercício de direitos existenciais, como é o caso do direito à saúde. Neste cenário, verifica-se a problemática do consentimento informado envolvendo pacientes com comprometimento neurocognitivo e psiquiátrico, vez que a aferição da vontade destes constitui tarefa complexa. A limitação no discernimento dos pacientes com este perfil, suplanta, por vezes, a aspiração normativa de lhes atribuir plena autonomia para a prática de atos existenciais. Uma interpretação sistemática permitiria harmonizar o art. 85, caput, do Estatuto da Pessoa com Deficiência, com a Convenção da Organização das Nações Unidas sobre os direitos das pessoas com deficiência, reconhecendo-se a abrangência do campo de aplicação da curatela quanto ao exercício do direito à saúde, nos casos dos pacientes citados. Assim, este artigo busca analisar o consentimento informado nas intervenções médicas realizadas nestes indivíduos, à luz da referida Convenção.
