The (I)Legality of the Decree of Pre-Trial Detention as a Means of Obtaining an Award-Winning Collaboration Agreement

Resumo: The theme of this paper is entitled “The (i)legality of the decree of pre-trial detention as a means of obtaining an award-winning collaboration agreement” and it intends to discuss and verify whether the decree of pre-trial detention as a means of obtaining an award-winning collaboration agreement is supported by the current legal system and whether in this scenario the Award-winning collaboration preserves its validity. For that I used mostly the methodology of dogmatic research, through theoretical analysis of the current legislation and doctrinal positions in comparison with the understanding of the Supreme Court using the empirical methodology in the collection and analysis of decisions. During the construction of the work, it was possible to verify the need to focus on the grounds used in the decree of pre- trial detention, since this would make it possible to verify whether the State could act in a coercive manner to obtain the award-winning collaboration agreement. When studying the grounds for the decree of pre-trial detention provided for in article 312 of the Code of Criminal Procedure, it was possible to see that the foundation of public order, instituted by inspiration of the German Code of Criminal Procedure of the National Socialist period, has a fluid and uncertain concept and can be used according to various understandings about it. Therefore, in the light of this study, it was found that in the face of an eventual employee who was arrested preventively, it is necessary to verify the real intention of the agent in concluding the award-winning collaboration agreement, i.e., whether there is voluntariness or coercion for such an act. With the justification of the decree of pre-trial detention on the basis of public order, this analysis of the intention of the arrested collaborator becomes more ambiguous, given its broad concept that can cover various situations of different natures, and can be used as an instrument of coercion, not knowing if to define exactly the reason for its decree - thus, public order excludes the voluntariness of the award-winning collaboration agreement.

Este trabajo se titula “De la (i)legalidad de la detención preventiva como medio para obtener un acuerdo de colaboración premiada” y tiene como objetivo comprobar si el decreto de detención preventiva como medio para obtener un acuerdo de colaboración premiado tiene soporte en el ordenamiento jurídico actual y si en este escenario la Colaboración Premiada conserva su validez. Para ello, se utilizó mayoritariamente la metodología de investigación dogmática, a través del análisis teórico de la legislación vigente y posiciones doctrinales en comparación con el entendimiento de la Corte Suprema Federal, empleando la metodología empírica en la recolección y análisis de decisiones. Durante la construcción del trabajo se pudo comprobar la necesidad de realizar una profundización sobre los motivos utilizados en el decreto de detención preventiva, ya que entonces se podría comprobar si el Estado podría actuar de forma coercitiva para obtener la conclusión de un acuerdo de colaboración premiada. Al estudiar los fundamentos del decreto de detención preventiva previsto en el artículo 312 del Código de Procedimiento Penal, se constató que el fundamento del orden público, instituido por inspiración en el Código de Procedimiento Penal Alemán del período nacionalsocialista, tiene un concepto fluido e incierto, y puede utilizarse de acuerdo con diversas concepciones sobre el mismo. A la vista de este estudio, se comprobó, por tanto, que, ante un eventual colaborador en detención preventiva, es necesario verificar la intención real del agente de celebrar el acuerdo de colaboración premiada, es decir, si hay voluntariedad o coacción para tal acto. Con la fundación del decreto de detención preventiva bajo la base del orden público, este análisis de la intención del preso se torna más lúgubre, dada su amplia conceptualización que puede abarcar diferentes situaciones de distinta naturaleza, y puede ser utilizado como instrumento de coacción, y no se sabe definir exactamente la razón de su decreto; por lo tanto, el orden público excluye la voluntariedad del acuerdo de Colaboración Premiada. Este trabalho tem como título “Da (i)legalidade da decretação de prisão preventiva como meio de obtenção de acordo de colaboração premiada” e tem por objetivo verificar se a decretação de prisão preventiva como meio de obtenção de acordo de colaboração premiada possui respaldo no ordenamento jurídico atual e se nesse cenário a Colaboração Premiada preserva sua validade. Para isso foi utilizada majoritariamente a metodologia de pesquisa dogmática, através de análise teórica da legislação vigente e de posições doutrinárias em comparativo com o entendimento do Supremo Tribunal Federal empregando a metodologia empírica na colheita e análise das decisões. Durante a construção do trabalho foi possível verificar a necessidade de realizar um aprofundamento sobre a fundamentação utilizada na decretação de prisão preventiva, pois assim seria possível verificar se o Estado poderia agir de modo coercitivo para obter a celebração de acordo de colaboração premiada. Ao estudar a fundamentação da decretação de prisão preventiva disposta no artigo 312 do Código de Processo Penal visualizou-se que o fundamento da ordem pública, instituído por inspiração no Código de Processo Penal Alemão do período nacional-socialista, possui um conceito fluído e incerto, podendo ser utilizado de acordo com diversos entendimentos acerca dele. Diante deste estudo verificou-se, portanto, que em vista de um eventual colaborador preso preventivamente é necessário verificar a verdadeira intenção do agente em celebrar o acordo de colaboração premiada, ou seja, se há voluntariedade ou coação para tal ato.
