Constitutional Guarantees and Covid-19: Constitutional Analysis in Times of Pandemic

Resumo: | States face enormous challenges in trying to protect their inhabitants from the threat of COVID-19, one year after the measures adopted by States that inevitably invaded the rights and freedoms, which are an integral and necessary part of a democratic society , a central challenge has always been posed to be able to amalgamate these “unhappy” measures with constitutional and international human rights norms. The legal analysis of the situation caused by the “pandemic” is as complicated to address as the pandemic itself: since, as we said before, it is extremely complex to achieve an adequate, fair and legal balance between the measures to stop the spread from the virus and protect the lives of its inhabitants, while fully respecting constitutional guarantees and human rights. |

The legal analysis of the situation caused by the “pandemic” is as complicated to address as the pandemic itself: since, as we said before, it is extremely complex to achieve an adequate, fair and legal balance between the measures to stop the spread from the virus and protect the lives of its inhabitants, while fully respecting constitutional guarantees and human rights.Los Estados se enfrentan a enormes desafíos al tratar de proteger a sus habitantes de la amenaza del COVID-19, a un año de las medidas adoptadas por los Estados que invadieron inevitablemente los derechos y libertades, que forman parte integrante y necesaria de una sociedad democrática, siempre se ha planteado como desafío central el poder amalgamar esas medidas “poco felices” con las normas constitucionales y las internacionales de derechos humanos. El análisis jurídico de la situación propiciada por la “pandemia” es tan complicado de abordar como la propia pandemia: ya que como dijimos anteriormente, es extremadamente complejo alcanzar un equilibrio, adecuado, justo y conforme a derecho, entre las medidas para frenar la propagación del virus y proteger las vidas de sus habitantes, y a su vez respetar plenamente las garantías constitucionales y los derechos humanos. Os Estados enfrentam enormes desafios para tentar proteger seus habitantes da ameaça da COVID-19, um ano após as medidas adotadas por Estados que inevitavelmente invadiram os direitos e liberdades, que são parte integrante e necessária de uma sociedade democrática, um desafio central tem sempre foi proposto ser capaz de amalgamar essas medidas “infelizes” com as normas constitucionais e internacionais de direitos humanos.
