Legal Acknowledgement of Difference as a Mechanism for the Effectiveness of the Rights of the Personality

Resumo: After the II World War, an international plan was prepared to enhance the dignity of the human person with greater value and to be employed by all States. The 1988 Constitution of Brazil insisted on the dignity of the human person as a basic principle of the State, coupled to equality as an essential factor towards the protection of fundamental rights and of the person. Currently the guarantee for equality is not enough and the need for the right to be different should be enhanced, directly linked to the entire development of the human person. This is not merely the rights of the personality but a special institution for their effectiveness. Current bibliographical review involving research in books, legislation and journals will show that the right to be different is a right of the personality and an essential basis for its development.

De este modo, en 1988, por intermedio de la Constitución Federal, Brasil aseguró la dignidad de la persona humana como principio basilar del Estado, así como la igualdad como elemento esencial a la protección de los derechos fundamentales y de la personalidad. Todavía, actualmente, la garantía del derecho a la igualdad no es suficiente, haciéndose necesario reconocer el derecho a la diferencia, haya vista que estas están directamente relacionadas al pleno desarrollo de la personalidad humana, constituyéndose, por lo tanto, no sólo en un derecho de la personalidad, sino también instituto esencial para la efectividad de estos. Así, por intermedio de revisión bibliográfica, a partir de la investigación en libros, legislaciones, revistas, se tiene por objetivo demonstrar el derecho a la diferencia como un derecho de la personalidad y fundamento esencial para el desarrollo de estos. Após a Segunda Guerra Mundial, surgiu no plano internacional a necessidade de destacar a dignidade da pesosa humana como valor maior a ser adotado por todos os Estados. Deste modo, em 1988, por meio da Constituição Federal, o Brasil assegurou a dignidade da pessoa humana como princípio basilar do Estado, bem como a igualdade como elemento essencial à proteção dos direitos fundamentais e da personalidade. Todavia, atualmente, a garantia do direito à igualdade não é mais suficiente, fazendo-se necessário reconhecer o direito à diferença, haja vista que estas estão diretamente ligadas ao pleno desenvolvimento da personalidade humana, constituindo-se, portanto, não só em um direito da personalidade, mas também instituto essencial para a efetivação destes. Assim, por meio de revisão bibliográfica, a partir da pesquisa em livros, legislações, revistas, tem-se por objetivo demonstrar o direito à diferença como um direito da personalidade e fundamento essencial para o desenvolvimento destes.
