Social Eugenics and the Rights of the Person: Reading Within the Field of Madness

Resumo: Compliance to law for the benefit of people with mental disorders is verified and the fundamental rights of the person are highlighted. Juridical and social responsibility is discussed. A bibliographic review of Psychiatric Reform was undertaken to humanize care of people with mental disorders and to detect references within legislation for the protection of people with mental disorders. The social exclusion due to mental disorders is a consequence of a hygiene stance with results for aesthetic production.

En el presente estudio se tuvo la intención de identificar el cumplimiento de la ley en beneficio de la persona que sufre con trastorno mental y poner de relieve los Derechos Fundamentales de la persona humana. Abordando de esta forma la responsabilidad jurídica y social. Se realizó una revisión bibliográfica de la Reforma Psiquiátrica que buscó, sobre todo, humanizar la atención de personas con tales trastornos, y aún, escudriñar dentro del derecho, leyes de referencia que propenden a la protección de aquellos que sufren con los trastornos mentales. De esta forma, se busca apuntar que la exclusión social de la locura deriva de un carácter higienista cuyo resultado lleva para producción estética. O presente trabalho teve como intenção identificar o cumprimento da lei em benefício da pessoa que sofre com transtorno mental e ressaltar os direitos fundamentais da pessoa humana, abordando desta forma, a responsabilidade jurídica e social. Foi realizada uma revisão bibliográfica da reforma psiquiátrica que buscou, sobretudo, humanizar o atendimento de pessoas com tais transtornos, e ainda, esquadrinhar dentro do direito, leis de referência que propendem para proteção daqueles que sofrem com os transtornos mentais. Desta forma, buscamos mostrar que a exclusão social da loucura deriva de um caráter higienista cujo resultado leva para produção estética.
