The Sexual Abuse Within the Family: A Violation of Personality Rigths of the Child and the Adolescent

Resumo: | Personality rights of the child and the adolescent enjoy special protection provided by the Federal Constitution, the Statute of Children and Adolescents and the whole legal system. The reason for this protection is the vulnerability of children and adolescents, because they can suffer domestic violence, whether physical, psychological or sexual. Sexual abuse includes all conducts that stimulate the adult sexually, such as fondling, penetration by objects, masturbation, exhibitionism, sodomy, rape, etc. The charges of child sexual abuse may be false, featuring parental alienation. This is common in court cases that discuss child custody. Victims of sexual abuse and parental alienation may have sleep and feeding disorders, aggressive behavior, confusion about sexual identity, depression, thoughts of death, and a tendency to use alcohol and drugs associated with crime. The sexual abusers and the alienating parents must be held responsible by both the civil and criminal legal systems. State intervention is necessary to adopt other appropriate measures, such as the withdrawal of the offender from his home, the reversal of custody, the application of administrative penalties, and, in severe cases, the suspension or termination of parental authority. Finally, all actions of government agencies and the courts must be guided in the best interest of children and adolescents, in order to protect their personality. |

Dicha protección es asignada en razón de la condición de vulnerabilidad del niño y del adolescente, los cuales están sometidos a prácticas de violencia intrafamiliar, sea física, psíquica o sexual. El abuso sexual abarca todas las conductas que estimulan sexualmente el adulto como caricias, penetración de objetos, masturbación, exhibicionismo, sodomía, penetración vaginal, etc. Es posible que las acusaciones de abuso sexual intrafamiliar sean falsas, caracterizando la enajenación parental. Eso es común en procesos judiciales que discuten la guardia de los hijos. Las víctimas de abuso sexual y de enajenación parental pueden presentar disturbios de sueño y alimentación, comportamiento agresivo, confusión en relación a la identidad sexual, depresión, suicidio o tendencia para el uso de alcohol y de drogas, asociados a la delincuencia. Los agresores y enajenadores deben ser responsabilizados en ámbito civil y criminal. Se hace necesaria una intervención estatal para la tomada de medidas como el alejamiento del agresor del hogar, el cambio de guardia, la aplicación de sanción administrativa, y, en casos más graves, la suspensión del derecho o destitución del poder familiar. Al fin, todas las acciones de órganos gubernamentales y del Judiciario deben ser pautadas en el mejor interés del niño y del adolescente, visando la protección integral de su personalidad.Os direitos da personalidade da criança e do adolescente gozam de proteção especial na Constituição Federal, no Estatuto da Criança e do Adolescente e no ordenamento jurídico como um todo. Tal proteção é conferida em razão da condição de vulnerável da criança e do adolescente, os quais estão sujeitos à prática de violência intrafamiliar, seja física, seja psíquica, seja sexual. O abuso sexual abrange todas as condutas que estimulam sexualmente o adulto, como carícias, penetração de objetos, masturbação, exibicionismo, sodomia, penetração vaginal etc. É possível que as acusações de abuso sexual intrafamiliar sejam falsas, caracterizando a alienação parental. Isso é comum em processos judiciais que discutem a guarda dos filhos. As vítimas de abuso sexual e de alienação parental podem apresentar distúrbios de sono e de alimentação, comportamento agressivo, confusão quanto à identidade sexual, depressão, suicídio ou tendência para o uso de álcool e de drogas, associados à delinquência. Os agressores e alienadores devem ser responsabilizados no âmbito civil e criminal. É necessária uma intervenção estatal para a adoção de outras medidas cabíveis, como o afastamento do agressor do lar, a inversão da guarda, a aplicação de sanção administrativa, e, em casos mais graves, a suspensão ou destituição do poder familiar.
