Resumo: | The present study aims to reflect on the direct action of unconstitutionality nº 5938 of the Federal Supreme Court before the prism of fundamental rights, focusing on the protection of motherhood and childhood. Throughout the study, the work of pregnant or lactating women in activities considered unhealthy was addressed, as well as the unconstitutionality of the norm arising from the Labor Reform, punctuated under the analysis of the 1988 Federal Constitution, violations of the rights to protect life, dignity of the human person, welfare and social justice, the social values of work, the rights of the unborn child and the newborn. The work developed proposes the application of the fundamental rights foreseen in the Federal Constitution of 1988, in addition to compliance with the principle of prohibition of social regression. |

The work developed proposes the application of the fundamental rights foreseen in the Federal Constitution of 1988, in addition to compliance with the principle of prohibition of social regression.O presente estudo visa realizar reflexões acerca da ação direta de inconstitucionalidade nº 5938 do Supremo Tribunal Federal perante o prisma dos direitos fundamentais, tendo como enfoque a proteção da maternidade e da infância. Ao longo do estudo foi abordado o trabalho da mulher gestante ou lactante em atividades consideradas insalubres, bem como a inconstitucionalidade da norma advinda com a Reforma Trabalhista, sendo pontuadas sob análise da Constituição Federal de 1988, as violações aos direitos de proteção à vida, à dignidade da pessoa humana, ao bem-estar e justiça social, aos valores sociais do trabalho, aos direitos do nascituro e do recém-nascido.
