Judicialization of medicines and their political-administrative legal and economic aspects: an integrative review

Resumo: Objective: the present study aims the better comprehension of the profile involved in the judicialization of the medicines, as well as the medicines judicialized and the economic impact of the process this integrative revision was carried out. Methods: The research was carried out in January of 2021, on the CAPES platform, were was researched in different data bases and was used the following terms: judicialization and medicines. Initially, all articles that were not revised by pairs were excluded, following of the read of titles and abstracts. The works selected were read in the entirety and collected the information’s related to the solicitant, prescriber, juridic aspects, aspects related to medicines and financial data. Results: In the present review it was not possible to relate if people that belongs in more privileged socioeconomical class are the most benefited by the judicialization process. Although is observed that in the private health system and advocacy offices are responsible for many economically disadvantaged and advantaged people processes. Medicines that are essential and high cost are judicialized, even though some medicines are not present in the clinical protocol. For the states, the costs of the medicines are high, but it is necessary that the access to the medicines are secured to the Brazilians. Conclusion: The medicines judicialization is complex, involving the guarantee of fundamental rights to citizens, aspects related to the market and the health services gestion.

Métodos: La investigación se realizó en enero de 2021, en la plataforma CAPES, siendo investigada en diferentes bases de datos y se utilizaron los siguientes términos: judicialización y medicamentos. Inicialmente, se excluyeron todos los artículos que no fueron revisados por pares, seguido de la lectura de títulos y resúmenes. Los trabajos seleccionados fueron leídos íntegramente y se recogió la información relacionada con el solicitante, prescriptor, aspectos legales, aspectos relacionados con medicamentos y datos económicos. Resultados: En esta revisión no fue posible relacionar si las personas pertenecientes a la clase socioeconómica más privilegiada son las mayores beneficiarias del proceso de judicialización. Sin embargo, se observa que los bufetes de abogados y de salud privados son responsables de varios casos de personas insuficientes y suficientes. Los medicamentos esenciales y de alto costo están legalizados y algunos medicamentos no están presentes en los protocolos clínicos. Para los Estados, los costos de la judicialización de las drogas son altos, sin embargo, es necesario que los brasileños tengan acceso a los medicamentos. Conclusión: La judicialización de los medicamentos es compleja, involucra la garantía del derecho fundamental del ciudadano, aspectos relacionados con el mercado y la gestión de los servicios de salud.Objetivo: o presente estudo teve como objetivo delinear o perfil dos atores envolvidos na judicialização dos medicamentos, bem como dos medicamentos judicializados e o impacto econômico destes na saúde, o que impulsionou a presente revisão integrativa. Métodos: A pesquisa foi realizada em janeiro de 2021, na plataforma CAPES, sendo pesquisada em diferentes bases de dados e foi utilizado os seguintes termos: judicialization and medicines. Inicialmente, foram excluídos todos os artigos que não foram revisados pelos pares, seguida da leitura dos títulos e resumos. Os trabalhos selecionados foram lidos na íntegra e coletadas as informações relacionadas ao solicitante, prescritor, aspectos jurídicos, aspectos relacionados aos medicamentos e dados financeiros. Resultados: Na presente revisão não foi possível relacionar se pessoas pertencentes a classe socioeconômica mais privilegiada são as maiores beneficiadas pelo processo de judicialização. No entanto, observa-se que a saúde privada e escritórios de advogados são responsáveis por vários processos de pessoas hipossuficientes e suficientes. Medicamentos essenciais e de custos elevados são judicializados, sendo que alguns medicamentos não estão presentes em protocolos clínicos. Para os Estados, os custos da judicialização dos medicamentos são elevados, porém, é necessário que seja assegurado o acesso aos medicamentos aos cidadãos brasileiros.
