Art Seal implications for Agribusiness Business Competitiveness: the case of artisanal food products of animal origin

Resumo: The Brazilian agri-food business has undergone reforms in its regulatory frameworks, which aim at promoting and making food production more competitive. Among the new regulatory frameworks is the Decree 9,918/2019, known as the Art Seal law, which establishes the criteria and supervision of the production of artisanal food of animal origin. The present study aimed to understand which competitive advantages the Law can promote to artisanal agri-food businesses of animal origin, through the theoretical articulation of the competitiveness models proposed by Porter (1993), Esser, Hillebrand, Messner & Meyer-Stamer (1996) and Farina (1999). Documentary and bibliographic consultations made it possible to understand that the ability to generate competitive advantages, especially for producers who are in the informal sector, is closely linked to the competence of the Public Power and related institutions to establish technical parameters that preserve food safety without imposing new costs to productive activities. In this sense, considering that assumptions of the Decree 9,918 / 2019 consists of simplifying the process of registration and regulation of products originating from small rural properties, enabling its commercialization in national scope, and adding value to them, keeping their particularities, it was verified that Decree 9,918 / 2019 does not bring institutional innovation that can promote greater competitiveness to businesses linked to the production of artisanal foods of animal origin.

Entre los nuevos marcos regulatorios se encuentra el Decreto nº 9.918/2019, conocida como la Ley del Sello Artístico, que establece criterios para monitorear la producción de alimentos artesanales de origen animal. El presente estudio tiene como objetivo comprender qué ventajas competitivas puede promover el Decreto nº 9.918/2019 para las empresas agroalimentarias artesanales de origen animal, a través de la articulación teórica de los modelos de competitividad propuestos por Porter (1993), Esser, Hillebrand, Messner & Meyer-Stamer (1996) y Farina (1999). Las consultas documentales y bibliográficas permitieron comprender que la capacidad de generar ventajas competitivas, especialmente para los productores que se encuentran en el sector informal, está estrechamente vinculada a la competencia del Poder Público y las instituciones relacionadas para establecer parámetros técnicos que preserven la seguridad alimentaria sin imponer nuevos costos para actividades productivas. En este sentido, considerando que los presupuestos del referido marco legal consisten en simplificar el proceso de registro y regulación de productos de pequeñas propiedades rurales, permitiendo su comercialización en el ámbito nacional y agregando valor a ellos, manteniendo sus particularidades, se verificó que El Decreto n° 9.918/2019 no aporta innovación institucional que pueda promover una mayor competitividad a las empresas vinculadas a la producción de alimentos artesanales de origen animal.O negócio agroalimentar brasileiro tem passado por reformas de seus marcos regulatórios que visam o fomento da competitividade da produção de alimentos. Dentre os novos marcos regulatórios está o Decreto nº. 9.918/2019, conhecido como a Lei do Selo Arte, que estabelece critérios de fiscalização da produção de alimento artesanal de origem animal. O presente estudo tem por objetivo compreender quais vantagens competitivas o Decreto nº 9.918/2019 pode promover aos negócios agroalimentares artesanais de origem animal, por meio da articulação teórica dos modelos de competitividade propostos por Porter (1993), Esser, Hillebrand, Messner e Meyer-Stamer (1996), e Farina (1999). Consultas documentais e bibliográficas permitiram compreender que a capacidade de gerar vantagens competitivas, principalmente para produtores que se encontram na informalidade do segmento, está intimamente ligada à competência do Poder Público e de instituições correlatas de estabelecerem parâmetros técnicos que guardam a inocuidade dos alimentos sem a imposição de novos custos às atividades produtivas. Nesse sentido, considerando que os pressupostos do referido marco legal consistem em simplificar o processo de registro e de regulamentação de produtos oriundos da pequena propriedade rural, viabilizar a sua comercialização em âmbito nacional e agregar-lhes valor, guardadas suas particularidades, verificou-se que o Decreto nº 9.918/2019 não traz inovação institucional que possa promover maior competitividade aos negócios ligados a produção de alimentos artesanais de origem animal.
