Obligations in the Civil Code in opposition to the Economic Analysis of Law

Resumo: | Introduction: The way in which Brazilian legislation came to light (mainly with the advent of the 1988 Constitution) shows us that individualism in the liberal-libertarian tradition has no place in our legal system. The exegesis of legal provisions and the decisions of the Courts over the decades proved that the principle of solidarity in private relations was definitely incorporated in Brazil. Objectives: To analyze the role of the State and, consequently, of Law, in the socioeconomic changes for this new post-modern and consolidation period. Thus exposing the way in which Brazilian legislation was written, in a so-called semi-open system, the power of the judge to interpret according to his best conviction will be studied. Methodology: Following the provisions of Mezzaroba and Monteiro, it will be studied from argumentative collisions, that the Law itself does not have the function of giving better predictability to business or serving a market logic. Again in opposition to the economic analysis of Law, the founding principles of the Law of Obligations will be used. Results and Conclusion: The current Civil Code broke with a technical-legal tradition that existed until then and has, recurrently, served the social purposes provided for in the Federal Constitution. Finally, starting from a brief historical evolution, it was seen that the Law has acted more actively than ever to consolidate the State budget in favor of a marketing bias. The three moments of the State were analyzed in terms of its budgetary guideline, according to the concepts of the German sociologist-economist Wolfgang Streeck |

La exégesis de las disposiciones legales y de las decisiones de los Tribunales a lo largo de las décadas demostró que el principio de la solidaridad en las relaciones privadas fue definitivamente incorporado en Brasil. Objetivos: Analizar el papel del Estado y, en consecuencia, del Derecho, en los cambios socioeconómicos para este nuevo período posmoderno y de consolidación. Exponiendo así la forma en que fue redactada la legislación brasileña, en un sistema denominado semiabierto, se estudiará la potestad del juez de interpretar según su mejor convicción. Metodología: Siguiendo las disposiciones de Mezzaroba y Monteiro, se estudiará a partir de colisiones argumentativas, que la Ley en sí misma no tiene la función de dar mejor previsibilidad a los negocios o atender una lógica de mercado. De nuevo en oposición al análisis económico del Derecho, se utilizarán los principios fundacionales del Derecho de las Obligaciones. Resultados y Conclusión: El Código Civil vigente rompió con una tradición técnico-jurídica existente hasta entonces y ha servido, recurrentemente, a los fines sociales previstos en la Constitución Federal. Finalmente, partiendo de una breve evolución histórica, se vio que la Ley ha actuado más activamente que nunca para consolidar el presupuesto del Estado a favor de un sesgo de marketing. Se analizaron los tres momentos del Estado en términos de su directriz presupuestaria, según los conceptos del sociólogo-economista alemán Wolfgang StreeckIntrodução: A maneira como as legislações brasileiras vieram à tona (principalmente com o advento da Constituição de 1988) nos mostra que o individualismo de tradição liberal-libertária não tem espaço em nosso ordenamento jurídico. A exegese dos dispositivos legais e as decisões dos Tribunais ao longo das décadas provaram que definitivamente se incorporou no Brasil o princípio da solidariedade nas relações privadas. Objetivos: Analisar o papel do Estado e, consequentemente, do Direito, nas mudanças socioeconômicas para este novo período pós-moderno e de consolidação. Expondo assim a maneira com que a legislação brasileira foi escrita, num sistema chamado de semiaberto, será estudado o poder ao julgador para interpretação conforme sua melhor convicção. Metodologia: Seguindo o disposto por Mezzaroba e Monteiro, será estudado a partir de colisões argumentativas, que o Direito em si não possui a função de dar melhor previsibilidade aos negócios ou de servir a uma lógica de mercado. Novamente em oposição à análise econômica do Direito, serão utilizados os princípios fundantes do Direito das Obrigações. Resultados e Conclusão: O Código Civil atual quebrou com uma tradição técnico-jurídica que existia até então e tem, recorrentemente, atendido aos fins sociais previstos na Constituição Federal. Por fim, partindo de uma breve evolução histórica, foi visto que o Direito tem atuado de forma mais ativa do que nunca para consolidar o orçamento do Estado em favor de um viés mercadológico.
