Formal job, informality and unemplyment in Brazil post Labor Reform (law 13467/2017)

Resumo: | Law 1347/2017 instituted Labor Reform in Brazil altering Consolidation of Labor Laws (Consolidação das leis do trabalho – CLT), decree-law 5452/1993, main legislative instrument of labor regulation in the country. The Reform was approved under government justification, form the need of modernizing and loosening rules contained in CLT, aiming to increase formal jobs creation with signed labor, to reduce informal job taxes and foment economics. This article aims to analyse governmental indexes of unemplyment , formal and informal job in the country after Labor Reform, so to verify if the alteration in legislation effectively fulfilled its purpose, reduced unemployment and informality and it raised the number of hiring with signed labor. To this research fulfillment, decriptive method of integrative review was used in literature from articles published in international and reputed national journals, works from law and economics authors and governmental statistic data analysis about unemployment and informality, colected in 2016, a year before implementation of law 13467/17 and on 20th february, month that preceeded Covid 19 pandemic in Brazil. Results found indicated that flexibilization broughty by the Reform contributed just a little to formal job generation and to reduce unemployment, there was a raise of informality indexes in the researched period and elevation of poverty and extreme poverty in Brazil. |

La Reforma fue aprobada bajo la justificación del Gobierno de la necesidad de modernizar y flexibilizar las normas contenidas en la CLL, con el objetivo de incrementar los puestos de empleos con contrato formal, reducir las tasas de empleo informal y fomentar la economía. Este artículo tiene como objetivo analizar los índices gubernamentales sobre desempleo, trabajo formal e informal en el país luego de la Reforma Laboral, con el fin de conocer si el cambio en la legislación cumplió efectivamente su propósito, redujo el desempleo y la informalidad y aumentó el número de licitaciones con contratos formales. Para la realización de esta investigación se utilizó el Método Descriptivo de Revisión de Literatura Integrativa basado en artículos publicados en revistas de renombre nacional e internacional, trabajos de autores de Derecho y Economía y análisis de datos estadísticos gubernamentales sobre desempleo e informalidad, recopilados entre 2016, un año antes de la entrada en vigor de la Ley 13.467 / 17 y febrero de 2020, mes que precedió a la pandemia de la Covid 19 en Brasil. Los resultados encontrados indicaron que la flexibilidad que trajo la Reforma contribuyó poco a la generación de empleos formales y a la reducción del desempleo, hubo un aumento en los niveles de informalidad en el período encuestado y un aumento de la pobreza y la pobreza extrema en el país.A Lei n° 13.467/2017 instituiu a Reforma Trabalhista no Brasil alterando a Consolidação das Leis Trabalhistas (CLT), Decreto-lei 5.452/1943, principal instrumento legislativo de regulamentação do trabalho no país. A Reforma foi aprovada sob a justificativa do Governo, da necessidade de modernizar e flexibilizar as regras contidas na CLT, com o intuito de aumentar os postos de emprego formal com carteira assinada, diminuir as taxas de trabalho informal e fomentar a economia. Este artigo tem como objetivo, analisar os índices governamentais sobre desemprego, trabalho formal e informal no país após a Reforma Trabalhista, afim de averiguar se a alteração na legislação efetivamente cumpriu seu propósito, reduziu o desemprego e a informalidade e elevou o número de contratações com carteira assinada. Para a realização desta pesquisa, foi utilizado o Método Descritivo de Revisão Integrativa de Literatura a partir de artigos publicados em revistas de renome nacional e internacional, obras de autores do Direito e da Economia e análise de dados estatísticos governamentais sobre desemprego e informalidade, coletados entre 2016, um ano antes da entrada em vigor da Lei 13.467/17 e fevereiro de 2020, mês que antecedeu a pandemia da Covid 19 no Brasil.
