Home education as public policy in Brazil:: An alternative to schools?

Resumo: Homeschooling consists of a model of continuous education in which the family is willing to directly preside over the teaching-learning process of children and adolescents until the end of basic education. Such practice is not allowed in the Brazilian legal system, however the discussion gains new momentum both by political movement and by the judgment of a paradigm appeal in the Supreme Federal Court. In this scenario, the objective of this article is to analyze the consequences of a possible regulation of home education in the education of children and adolescents. As specific objectives, it stands out: to identify the main actors that mark the issue of homeschooling in Brazil; analyze the foundations presented to justify the implementation of a public policy regulating the problem; study the elementary structures of public policies, especially those related to basic education and identify the bottlenecks of public educational policies. The methodology used was bibliographic research, through qualitative analysis. In this sense, it is stated that the regulation of the Draft Laws for the release of homeschooling does not prove to be a solution capable of solving or at least mitigating the problem, since it would only serve a very small portion of the population that would have economic conditions to supply schools in the domestic sphere, with education being the obligation of those responsible for the student, a power-duty for the family as well as for the State.

Tal prática não é permitida no ordenamento jurídico brasileiro, porém a discussão ganha novo fôlego tanto por movimentação política quanto pelo julgamento de um recurso paradigma no Supremo Tribunal Federal. Nesse cenário, o objetivo deste artigo á analisar os desdobramentos de uma possível regulamentação do ensino domiciliar na formação das crianças e adolescentes. Como objetivos específicos, destaca-se: identificar os principais atores que marcam a questão do homeschooling no Brasil; analisar os fundamentos apresentados para justificar a implementação de uma política pública regulando a problemática; estudar as estruturas elementares das políticas públicas, em especial aquelas ligadas à educação básica e identificar os gargalos das políticas públicas educacionais. A metodologia utilizada foi a pesquisa bibliográfica, através de análise qualitativa.
