The law of contracts and obligations in the new Civil and Commercial Code of Argentina and its relations with consumer law

Resumo: This article reflects about the reception of the rules contained in the Argentinian Civil and Commercial Code about contracts and obligations – which began to rule in 2015 – from the point of view of its relations with the consumer law. This regulation has generated a high impact on private law in Argentina especially because it clearly distinguishes two main areas: contracts with consumers from contracts that do not have such quality. This new panorama forces to rethink the traditional criteria of the election of the applicable law that remained valid for decades. In this context the paper analyses the main aspects of the Argentinian new legal regime applicable to contracts and obligations that have the characteristic of being “consumer”. A dogmatic approach was selected as the methodological way.

A dogmatic approach was selected as the methodological way.En el presente artículo se realiza un breve examen sobre la recepción del derecho de los contratos y de las obligaciones en el Código Civil y Comercial de Argentina – que comenzó a regir en el año 2015 – desde el punto de vista de sus relaciones con el derecho del consumidor. Dicha regulación ha generado un alto impacto en el derecho privado patrimonial de Argentina ya que distingue nítidamente dos grandes ámbitos: los contratos con consumidores y por otra parte los contratos que no revisten dicha calidad. Este nuevo panorama obliga a replantear los criterios tradicionales que durante décadas se mantuvieron vigentes, principalmente, en el derecho de los contratos, pero también en el derecho de obligaciones. En tal contexto se analizan los principales aspectos del nuevo régimen legal aplicable a los contratos y obligaciones que presentan la característica de ser “de consumo”.
