Resumo: | This article addresses the use of artificial intelligence (AI) as a means of helping the magistrate in their judicial decisions and the ability of these systems to decide, satisfactorily. The general objective is to analyze the use of AI by the Judiciary, especially regarding the possibility of artificial systems to aid the magistrate's activity in rendering decisions. Regarding the research problem, it is rooted in the question whether in the future AI systems will be able to replace the magistrate in making their decisions. As an initial hypothesis, it is verified that AI systems do not yet have the capacity to decide equitably or to perform the weighting technique when there is a collision of fundamental rights. The method used is the hypothetical-deductive method, based on a literature review and scientific articles. To this end, it first addresses what is understood by AI and its contribution to the activity of the magistrate in rendering their decisions. Next, it analyzes the rendering of the sentence, the legal brocard "Iuria Novit Curia" and the judgment of equity, evaluating the contribution of AI in these processes. |

Como objetivo geral, analisa-se o uso da IA pelo Poder Judiciário, especialmente quanto à possibilidade de sistemas artificiais auxiliarem a atividade do magistrado na prolação de suas decisões. Quanto ao problema de pesquisa, radica no questionamento se no futuro os sistemas de IA poderão substituir o magistrado na elaboração de suas decisões. Como hipótese inicial verifica-se que os sistemas de IA ainda não possuem a capacidade de decidir com equidade ou realizar a técnica da ponderação quando houver colisão de direitos fundamentais. O método utilizado é o hipotético-dedutivo, fundamentado em pesquisa em revisão bibliográfica e artigos científicos. Para tanto, aborda inicialmente o que se entende por IA e a sua contribuição para a atividade do magistrado em proferir suas decisões.
