Concessão de uso em Unidades de Conservação de proteção integral: um panorama sobre as possíveis implicações do PL 249/2013

Resumo: | The creation of Conservation Units (UC) is an important strategy for biodiversity protection, but without an integrated management with society, it is not enough to ensure the protection of natural resources and conservation of natural environments. Limitations in management by government agencies lie in the lack tools, resources and investments. In this context, the concession of areas of public use in these protected areas, already widely practiced in other countries, is practiced in Brazil without specific legislation. In 2013, the government of São Paulo State created a bill (PL) for this purpose. This study evaluates the implementation of previous legislation in Brazil on concession in UCs and verifies the implications of this PL, recently approved in the form of Law 16260/2016. The study was conducted through document analysis. 31 documents were analyzed, including academic papers, news, formal statements, legal documents, documents related to concessions and others. In addition to the concession of the areas of public use, this law also allows for the commercial exploitation of timber resources and forestry by-products in the areas provided for in the UC Management Plan (PM). The debate of the PL and approval of the law occurred without a broad discussion with society and it became clear, both through the media, and through legal demonstrations, discontentment of experts and environmentalists. But there is still the possibility of action of NGOs, prosecutors and other experts with technical and legal support in the preparation of reference terms, PMs, public contracts and audiences. In these steps there is room for attempts to eliminate the gaps and make sure concessions do not affect the biodiversity protection within Ucs, combined with public access |

As limitações de gestão giram em torno da dificuldade dos órgãos do governo em disponibilizar os instrumentos necessários ao manejo das áreas e falta de recursos e investimentos. Neste contexto, a concessão das áreas de uso público destas áreas protegidas que já é amplamente praticada em outros países, começou a ser praticada no Brasil sem uma legislação específica para UCs. Em 2013 o governo do Estado de São Paulo Criou um Projeto de Lei (PL) com este objetivo. Este trabalho procura avaliar a aplicação da legislação vigente no Brasil sobre o tema concessão de uso nas UCs e verificar as implicações deste PL, recentemente aprovado na forma da Lei 16260/2016. O trabalho foi desenvolvido por meio de levantamento e análise de documentos. Foram analisados 31 documentos, entre eles documentos acadêmicos, notícias, manifestações formais, documentos legais, documentos relacionados com concessões em vigor e outros. Além da concessão das áreas de uso público, a Lei também prevê a exploração comercial de recursos madeireiros ou subprodutos florestais nas áreas previstas no Plano de Manejo (PM) da UC. A tramitação do PL e aprovação da Lei ocorreram sem uma ampla discussão com a sociedade e apoio técnico na elaboração da mesma, o que pode trazer implicações negativas, além disso ficou evidente, tanto por meio da mídia, quanto por meio de manifestações legais, o descontentamento de especialistas e ambientalistas. Mas ainda há possibilidade de atuação das ONGs, Ministério Público e outros especialistas, com apoio técnico e legal na elaboração dos Editais, PMs, contratos e audiências públicas.
