Amicus curiae as a friend of procedural democracy in the production of decision-making standards that deal with human rights

The realization of human rights cannot be subject to judicial discretion. The construction of democratic decision-making standards is necessary. In this sense, the research hypothesis of this article is based on the elucidation of the question: how can the amicus curiae be an important tool in listening to vulnerable groups, those who could potentially be affected by the judicial decision, or even society in general? In this answer lies the general objective of the article. The proposed theme will be worked through the deductive method, based on bibliographic and documental research. It concludes that the amicus curiae is an important instrument in the democratic formation of decision-making patterns related to human rights issues, in attention to constitutionally established citizenship and that legitimizes social transformations.
