Da legalidade à realidade: o uso do serviço público de educação para pessoas com transtorno do espectro do autismo na cidade de São Paulo

This study had the general object map the public education service provided by the State of São Paulo and the São Paulo City for people with autism spectrum disorder (ASD) from the database of one of the units of the Public Defender s Office of the State of São Paulo. Its specific objectives are: a) identify, from documentary research of normative texts, since the Federal Constitution and the Convention on the Rights of Persons with Disabilities to Laws and Decrees of the State and the Municipality of São Paulo that deals the right to education guaranteed to persons with ASD; b) identify, from documentary research publications of the Official Gazette, the public education services provided by the State and the Municipality of São Paulo in São Paulo, through public schools and government contracts for people with ASD; c) identify, based on questionnaires answered by family members of people with ASD, the socioeconomic profile of the families and public education services used by people with ASD; d) identify, based on questionnaires answered by family members of people with ASD, violations of the right to education reported in the Public Defender s Office of the State of São Paulo. In analyzing the data, it was possible to compare literature and research on legislation and issues of the Official Gazette of the State and the City of São Paulo. The survey results indicate that most people with autism spectrum disorder whose parents came to Public Defender s Office use public service provided by private educational institutions paid by State of São Paulo which is a specialized educational services that often replaces the regular school. Furthermore, this public service provided is a result of class action filed in 2000 which condemned the state of São Paulo to provide appropriate care for people with autism spectrum disorder in the areas of health, education and assistance. It was observed that there is a dissatisfaction with the local and state public education service (regular schools). Then, mothers, fathers and caregivers of people with ASD came to Public Defender s Office to ask for registration in private educational institutions paid by State of São Paulo (special schools) or support mesaures in regular schools. Finally, even for private educational institutions paid for the State od São Paulo (special schools) satisfaction is not complete because mothers and fathers of people with ASD came to Public Defender s Office to ask for specialized transportation. It was 7 found, therefore, that after more than eight (8) years of the final judgment of the class action there is dissatisfaction with the policy adopted.
