Summary: The general objective of the present work is to analyze whether Law 12.764 / 12 offers a dignified quality of life to people with autism. The approach method was the deductive and the monographic and comparative procedure methods. The research is exploratory, with a qualitative approach to bibliographic and documentary procedures. Among the main results found with a research stand out: A) Law 12.764 / 12 popularly known as Berenice Piana recognized the autism spectrum disorder as a disability and gave the autistic person the protection given as people with disabilities. B) The Statute of the Person with Disabilities started to consider people with disabilities, including, therefore, autistic people, as capable people needing to resort to the judiciary through the trusteeship to have their disability recognized in the known modality, so that, no more a figure of the absolutely incapable for the disabled is admitted. C) The Brazilian regulations related to the subject are positive and advanced. D) There is a lack of public inspection policies and compliance with existing regulations for the realization of the rights conferred as people with autism so that the constitutional principles are not harmed.

O método de abordagem foi o dedutivo e os métodos de procedimento monográfico e comparativo. A pesquisa é de nível exploratório, de abordagem qualitativa e de procedimentos bibliográfico e documental. Dentre os principais resultados encontrados com a pesquisa destacam-se: A) A Lei 12.764/12 popularmente conhecida como Berenice Piana reconheceu o transtorno do espectro autista como deficiência e conferiu ao autista a mesma proteção dada as pessoas com deficiência. B) O Estatuto da Pessoa com Deficiência passou a considerar as pessoas portadoras de deficiência, incluindo portanto, os autistas, como pessoas capazes necessitando recorrer ao judiciário por meio da curatela para ter sua incapacidade na modalidade relativa reconhecida, de modo que, não mais se admite a figura do absolutamente incapaz para o deficiente. C) As normativas brasileiras atinentes ao assunto são positivas e avançadas.
