Resumo: The present article deals the question of re-reading the principles about social function and the company maintenance as an activity designed for the production and circulation of goods and services which has to meet to the collective interests. To this dynamic is linked a social function in which is sought the role of company maintenance can usually perform to promote afairerandsupportivesociety.Itisatheoretical-bibliographical-naturedresearchguidedby a descriptive-analytical method which had instructed the analysis of constitutional and infraconstitutional laws, as well as the doctrine that informs the concepts of dogmatic order.

A esta dinâmica vincula-se uma função social em que se busca especificar o papel em que a preservação da empresa pode desempenhar para a construção de uma sociedade justa e solidária.
