Text and Context of the Brazilian Constitutionalism: Readings from the Latin American Constitutionalism of the XXI Century

Resumo: The twentieth and twentieth-first century marks Latin America with the design of the Plurinational State that behaves like a new constitutionalist matrix within an Andean design philosophy. Question : Is overcoming the constitutional matrices that influenced the Brazilian Constitution of 1988 , through the importance of recognizing legal pluralism and the discourse of Latin American constitutionalism, relevant to performing structural and literal changes  in  the  Constitution?  The  proposal  is  to  analyze  the  constitutional  political existentialism, ponder if we are fruits of Europe, or if it is possible, from European influence, to build something different based on local philosophy and sociology.

Este trabalho se insere nesse contexto e se orienta pela seguinte pergunta: superar as matrizes constitucionais que influenciaram a Constituição brasileira de 1988, pela importância de reconhecer o pluralismo jurídico e o discurso do constitucionalismo latino americano, importa em realizar mudanças estruturais e literais na Constituição?
