The Rebuild Bodies: Intersexuality, Medical Practice and the Right to Health

Resumo: Historically the body is conditioned to rules of heterosexual and binary way. The intersexual existence violates the binary norms and therefore the intersexed people are relegated to invisibility and reduced anomalies condition that need to have their rebuilt bodies through medical interventions called surgeries standardization of sex. This article aims to discuss how the medical practice acts on intersex bodies from sex standardization surgeries, and if they violate the right to health of people with anomalies in sexual development, on the premise that the right to health is a human right protected by domestic law and international. Methodologically, to build this research and understanding of the categories as body, gender, sex, social invisibility and intersexuality was used poststructuralist method by foucault matrix. As a result it was found that the sex standards operations constitute one of the most effective way for social invisibility of intersex, besides being also as a means of violating the right to health of these people.

A existência intersexual transgride as normas binárias e por isso, as pessoas intersexuais são relegadas a invisibilidade e reduzidas a condição de anormais que necessitam ter seus corpos refeitos através de intervenções médicas denominadas cirurgias de normalização do sexo. O presente artigo tem por objetivo discutir como a prática médica atua sobre os corpos intersexuais a partir das cirurgias de normalização do sexo, e, se estas violam o direito à saúde das pessoas com anomalia no desenvolvimento sexual, partindo da premissa que o direito à saúde é direito humano protegido pelo direito interno e internacional. Metodologicamente, o manuscrito é uma revisão bibliográfica e para construção da pesquisa e a compreensão das categorias como corpo, gênero, sexo, invisibilidade social e intersexualidade foi utilizado o método pós-estruturalista de matriz foucaultinana.
