Resumo: Have the rights of transsexual individuals been recognized in the current panorama of the Brazilian prison system? This article aims to describe, analyze and verify how the State has treated this population in the prison system and promote debate on the conditions of the incarcerated transgender population. This is a qualitative study, with bibliographical research (doctrine and jurisprudence). As a theoretical framework, this article was based on studies by FOUCALT (1975), BENTO (2016), BENEVIDES AND NOGUEIRA (2020), GRECO (2020) and (YOGYAKARTA (2007). Recently, the legal system welcomed the enactment of legal provisions that aim to reduce the vulnerability of incarcerated transgender women and men. However, the specific issue of the allocation of these individuals in prison spaces, with the preservation of the guarantee of fundamental rights is still quite complex. And because it is the object of discussion in various sectors of society, this problem gives this article the legal and social relevance inherent to the theme. Keywords: Transsexuality. Dignity.
