Resumo: It seeks to study the secondary victimization caused within the criminal process by public agents and lawyers, with a focus on application in crimes of rape of vulnerable, based on the case of “Mariana Ferrer”. It was used if bibliographic research, scientific articles and legislation to understand the problem of recurrent victimizing process in the current criminal procedural code that affects the victim's rights. At first, the subjects of the process were presented. In this sense, the figure of the victim and their historical participation in the process, with emphasis on the emergence of the victimological study, covering the primary and secondary victimization phenomena. Afterwards, an analysis of the case “Mariana Ferrer”, emphasizing the victim's hearing from the victimological point of view. Finally, legislation was analyzed with proposals to reduce procedural victimization, in order to protect the rights of victims
