Resumo: The study of the topic of legislative change, regarding the occurrence of guilty homicide in the direction of a motor vehicle under the influence of alcohol, involves questions regarding the limits of conscious guilt and eventual deceit and the purpose and consequences of this change in the social sphere . After 21 years of the promulgation of Law 9,503 / 1997, in the part that deals with the crime of guilty homicides caused by drivers under the influence of alcohol or another addictive psychoactive substance, the minimum penalty of the infraction was raised to five years, article 302, paragraph 3 of said law, approaching the minimum penalty of willful homicide.
