O papel da defensoria pública como ator de efetivação e fomento de políticas públicas para a defesa do direito fundamental à saúde das crianças acometidas pela síndrome congênita do Zika

This research aimed to understand how the Public Defender's Office can act to implement and promote public policies to defend the Fundamental Right to health of children affected by Congenital Zika Syndrome. Therefore, it was described the daily care performed by the Public Defender's Office to the families of these children, presenting the difficulties commonly reported by these assisted. The main collective judicial and political (extrajudicial) measures were mapped, with preponderance for this last form of action, adopted by the aforementioned Institution for the promotion and protection of fundamental rights of these children, related to the Right to Health. The main collective political practices promoted by the Public Defender's Defenders of the States of Alagoas were also exposed, Espírito Santo and Bahia for the promotion and defense of rights and institution of public health policies for these children, in the years 2017 to 2019, which represented legal gains for this vulnerable group, and finally, the performance of the Public Defender's Office as an agent for the realization of rights and promotion of public policies for children victimized by the aforementioned disease was analyzed. As theoretical and methodological paths, Michael de Certeau's Theory of Practices was used, focusing on the ways of operation experienced by ordinary individuals from the perception of strategies and tactics developed in daily life, using as instruments of research and elaboration of the text narrative conversations and images with public defenders imbued with this activity, seeking to give visibility to their ways of doing in the search for the effectiveness of the health rights of this hypervulnerabilized group. In conclusion, by performing political practices of microresistance, the Public Defender's Office can act to implement and promote public policies to defend the Fundamental Right to health of children affected by Congenital Zika Syndrome, as an authentic Multiport Center, building new paths that enable the realization and expansion of the rights for these infants and their families
