The gender knocking at the door of the Brazilian Supreme Court: the search for a feminist constitutionalism

Resumo: | This article thematizes the performance of feminist constitutionalism in the Brazilian Supreme Court, resulting in a gender perspective in the decisions of this Court. In this context, the feminist constitutionalism makes it possible to understand the structure of the discourse of gender, which are embodied in constituent processes and constitutions, resulting in empowerment or subordination of women. It was intended to answer the following question: before the feminist constitutionalism, what is the role of the Brazilian Supreme Court in the construction and insertion of a gender perspective in Brazilian jurisprudence? The objective of this research is to draw decisions of the Brazilian Supreme Court that outline a perspective of this constitutionalist theory. The research method was deductive. The results indicate that despite the Court’s many advances in the promotion and inclusion of a vision of feminist constitutionalism in jurisprudence, there are many legal and cultural ties that preclude or delay the maturation of women’s emancipation and legal empowerment. |

Nesse panorama, o constitucionalismo feminista permite compreender os discursos e os enunciados de gênero que são incorporados nos processos constituintes e nas constituições, resultando tanto na emancipação e no empoderamento jurídico ou em formas de subordinação. Pretende-se responder à seguinte pergunta: no contexto do constitucionalismo feminista, qual o papel do STF na construção e na inserção de uma perspectiva de gênero na jurisprudência brasileira? O objetivo deste trabalho é mapear decisões da Suprema Corte brasileira que desenhem uma prospectiva dessa teoria constitucionalista. O método de pesquisa utilizado foi o dedutivo.
