O Direito à Saúde é parte fundamental do direito à vida e um dever do Estado em face à Constituição Federal.Contudo, tem-se invocado a teoria da reserva do possível para estear a escassez de recursos na área da saúde sob a alegação de afronta ao princípio da separação dos poderes, à repartição de competências e aos repasses orçamentários. O presente artigo trará uma reflexão sobre a invocação dessa teoria e a sua relação com o investimento constitucional mínimo e a necessidade da intervenção do Judiciário para a efetivação dos direitos fundamentais diante das ingerências da Administração Pública. Para a formalização deste estudo, foram utilizados os métodos hipotético-dedutivo e o hermenêutico por meio da pesquisa jurisprudencial do Supremo Tribunal Federal e da revisão bibliográfica.  Palavras-chave: Direito à Saúde. Investimento Constitucional Mínimo.    ABSTRACT The Right to Health is a fundamental part of the right to life and a duty of the State in the face of the Federal Constitution, however, the theory of reserve of the possible has been invoked to support the scarcity of resources in the health area under the allegation of an affront to the principle of separation of powers, the division of powers and budget transfers. This article will reflect on the invocation of this theory and its relationship with the minimum constitutional investment and the need for the intervention of the Judiciary for the realization of fundamental rights in the face of interference by the Public Administration. For the formalization of this study, the hypothetical-deductive and the hermeneutic method were used through the jurisprudential research of the Federal Supreme Court and the bibliographic review. Keywords: Right to Health.
