Resumo: | Reflect on Legitimacy, its complexities and dimensions is the challenge of this article. Not restricted to the analysis of institutionalized relationships, the concept is used in several areas of knowledge, such as Law and Political Science, the object of this article. Using the dialectical method, this reflection is supported by the contribution of Max Weber, from which Legitimacy acquires its own identity in the face of Legality. From Weber's reach and conceptual quality, the overflow of legitimacy beyond the bureaucratic/institutional spheres of domination, reaching the set of societal relations is highlighted. After all, if the one who holds the prerogative of attributing legitimacy (or not) to a given relationship is who is in the subordinate condition of the relationship, types of legitimacy of a different nature are made explicit. As a result, this article proposes a functional subdivision of the Legitimacy concept: Conventional and Conjunctural. |

Não restrito à análise das relações institucionalizadas, o conceito é utilizado em várias áreas de conhecimento, como Direito e Ciência Política, objeto deste artigo. Utilizando-se do método dialético, esta reflexão ampara-se na contribuição de Max Weber, a partir do qual a Legitimidade adquire identidade própria frente à Legalidade. A partir do alcance e qualidade conceitual de Weber, destaca-se o transbordamento da legitimidade para além das esferas de dominação burocráticas/institucionais, alcançando o conjunto das relações societárias. Afinal, se aquele que detém a prerrogativa de atribuir legitimidade (ou não) à determinada relação é quem está na condição subalterna da relação, explicitam-se tipos de legitimidade de natureza distinta.
