Resumo: The present dissertation undertakes a philosophical and scientific study of the interface between Law, Politics and Economy, highlighting the relevance of the Judiciary as an instrument for achieving sustainable development. The theme is justified by the need to materialize the project designed by the Brazilian Constitution. The Brazilian scenario presents a policrism because of the corruption and inertia of the powers of the Republic. This favored the protagonism of the Judiciary, exuding phenomena such as “Judicial Activism” and “Judicialization of Politics”. Having as its object Constitutional Law, Economic Law, Political Science and Philosophy of Values, the epistemological cut is based on the analysis of a core of fundamental rights, whose effectiveness is the condition of possibility of development. The general scope is the elaboration of a Brazilian theory for the interpretation and effectiveness of fundamental rights, with the specific objective of pointing out the complexities and paths to development. It is hypothesized that the Judiciary, with its potentialities and vicissitudes, in applying the norm and constitutional axiology begins the process of sustainable development. It is problematic to open a line of investigation to verify if there is a hegemonic economy dominating the other social actors, because how is underdevelopment possible, with Brazil being one of the largest economies in the world? In the search for a new paradigm of interpretation and effectiveness of fundamental rights in keeping with Brazilian socioeconomic reality, the hypothetical-deductive method will be adopted, with a modern theoretical framework and extensive bibliography.

O tema se justifica ante a necessidade de se materializar o projeto desenhado pela Constituição Brasileira. O cenário brasileiro apresenta uma policrise por causa da corrupção e inércia dos poderes da República. Isso favoreceu o protagonismo do Judiciário, exsurgindo fenômenos como o “Ativismo Judicial” e a “Judicialização da Política”. Tendo como objeto o Direito Constitucional, Direito Econômico, Ciência Política e Filosofia dos Valores, o corte epistemológico delineia-se a partir da análise de um núcleo de direitos fundamentais, cuja efetividade é a condição de possibilidade do desenvolvimento. O escopo geral é a elaboração de uma teoria brasileira para a interpretação e efetivação dos direitos fundamentais, sendo objetivo específico apontar as complexidades e caminhos para o desenvolvimento. Tem-se como hipótese que o Judiciário, com suas potencialidades e vicissitudes, ao aplicar a norma e a axiologia constitucional inicia o processo do desenvolvimento sustentável. Problematiza-se abrindo uma linha de investigação para se comprovar se há uma economia hegemônica dominando os demais atores sociais, pois como é possível o subdesenvolvimento, sendo o Brasil uma das maiores economias mundiais?
